U.S. Tax Filing for F-1 Students, OPT & STEM OPT
Studying or working in the United States on F-1, OPT or STEM OPT and unsure which tax return you need to file?
Your immigration status does not by itself determine whether you should file Form 1040 or Form 1040-NR. Your U.S. tax residency, time spent in the United States, income and individual circumstances can affect your filing requirements.
ACB Consultants helps international students and professionals understand their U.S. tax filing requirements and prepare the appropriate federal and state tax returns.

Do You Need to File Form 1040 or Form 1040-NR?
One of the most common questions international students have is whether they should file Form 1040 or Form 1040-NR.
Being on an F-1 visa does not automatically determine which income tax return you should file. U.S. tax residency is determined under federal tax rules, including the substantial presence test and applicable exceptions.
Depending on your circumstances, you may be treated as a resident alien or nonresident alien for U.S. income tax purposes.
Filing the appropriate return is important because Form 1040 and Form 1040-NR apply different tax rules.
Documents You May Need
The documents needed depend on your circumstances — not everyone will need every item. Common examples include:
- Form W-2
- Form 1042-S
- Form 1099, if applicable
- Passport and visa information
- Form I-20
- Employment Authorization Document (EAD), where relevant
- U.S. entry and travel history
- Previous U.S. tax returns
- Social Security Number or ITIN, if applicable
- State income documents, where applicable
Social Security & Medicare Taxes on F-1 and OPT Income
Some F-1 students who are nonresident aliens for U.S. tax purposes may qualify for an exemption from Social Security and Medicare taxes on certain authorized employment.
Eligibility depends on your tax residency, immigration status, type of employment and individual circumstances.
If Social Security or Medicare taxes appear to have been withheld incorrectly, we can review the situation with you and explain the options that may be available. Whether any amount can be recovered depends on the facts.
